Terms of Service

These Terms of Service (“Terms”) govern your use of Budget Hub. They form a binding contract between you and Budget Hub (operated by Dalton Marhufu as sole proprietor, “we”, “us”), a South African business. Our registered address is available on request via [email protected].

By creating an account or otherwise using Budget Hub you accept these Terms and our Privacy Policy. If you do not accept them, you must not use Budget Hub.

1. Eligibility

  • You must be at least 18 years old.
  • You must have the legal capacity to enter into a binding contract under South African law.
  • You must provide accurate, current, and complete account information.
  • You must not be barred from receiving the service under any applicable law.

2. The service

Budget Hub is a personal and business finance management platform. Features include income / expense tracking, savings goals, investment tracking, business revenue and expense tracking, tax calculations, bank statement imports, receipt OCR, and AI-generated insights.

We may add, change, or remove features at any time. Where a change materially reduces the functionality of a paid plan you are subscribed to, we will give you reasonable notice and a pro-rata refund if applicable.

3. Your account

  • You are responsible for keeping your password confidential.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at [email protected] if you suspect unauthorised access.
  • You must not share, sell, or transfer your account.
  • You must not create more than one account for the same person without our written permission.

4. Subscriptions, billing, and refunds

  • Prices are in South African Rand (ZAR) and inclusive of VAT where applicable.
  • Paid subscriptions renew automatically until you cancel.
  • You can cancel at any time in your account settings; cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partial months. If you cancel mid-cycle you keep access until the period ends.
  • We may change prices with at least 30 days’ notice. Existing subscriptions continue at the price they were started on until the next renewal after the notice period.
  • Failed payments may result in your subscription being downgraded to the Free plan. We will email you before this happens.

5. Beta and grandfathered users

If you signed up during a publicly-announced beta period and we granted you grandfathered pricing or lifetime access, those terms are recorded on your account and remain in force for as long as you keep your account in good standing.

6. Your content and data

All financial information, transactions, goals, and other data you enter belong to you. You grant us a limited licence to store, copy, process, and display this data solely to provide the service to you. We do not claim ownership of your data.

You can export your data at any time via the export tool in your account, and you can delete your data by deleting your account.

7. Acceptable use

You must not:

  • Use Budget Hub for any unlawful purpose, including money laundering or tax evasion.
  • Upload viruses, malware, or any code designed to harm the service or other users.
  • Attempt to gain unauthorised access to any part of the service or another user’s account.
  • Reverse-engineer, decompile, or scrape the service except as permitted by law.
  • Resell or redistribute the service or its content without our written permission.
  • Submit false, misleading, or fraudulent information.
  • Use the service to send spam or unsolicited messages.
  • Interfere with the proper functioning of the service or place an unreasonable load on our infrastructure.

8. Intellectual property

The Budget Hub name, logo, software, design, copy, and any other materials we publish belong to us. You may use the service for its intended purpose but you may not copy, modify, distribute, or create derivative works without our written permission.

Open-source components used by Budget Hub remain under their own licences.

9. AI-generated insights

Budget Hub uses AI models (via OpenRouter) to generate written insights from your financial data. These insights are produced automatically and may be inaccurate, incomplete, or out of date.

AI insights are not financial advice. Do not rely on them when making financial decisions. See section 10.

10. Not financial advice

Budget Hub is a tool to help you track your money. It does not provide financial, tax, investment, or legal advice. The information, calculations, projections, and insights shown in Budget Hub are for general informational purposes only.

Always consult a qualified financial advisor, tax practitioner, or legal professional before making financial decisions. We accept no responsibility for decisions you make based on information displayed in Budget Hub.

11. Third-party services

Budget Hub depends on third-party services (PayFast for payments, Brevo for email, Supabase for database, Google Cloud Vision for OCR, OpenRouter for AI insights, Vercel for hosting, Sentry for error monitoring, Cloudflare for bot protection). We are not responsible for outages, errors, or data losses caused by these providers, but we will work in good faith to restore service as quickly as reasonably possible.

12. Disclaimer of warranties

To the maximum extent permitted by law, Budget Hub is provided “as is” and “as available”. We do not warrant that the service will be uninterrupted, error-free, secure against every possible attack, or that it will meet your specific requirements. This does not exclude any warranty implied by the Consumer Protection Act 68 of 2008 where it applies.

13. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, consequential, special, or punitive damages.
  • Our total aggregate liability to you for any claim arising out of or related to these Terms or the service is limited to the amount you paid us for the service in the 12 months before the claim arose, or R1,000, whichever is greater.
  • Nothing in these Terms excludes liability that cannot be excluded under South African law (including liability for death, personal injury caused by negligence, fraud, or any liability under the Consumer Protection Act that cannot be waived).

14. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, damage, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the service, or your infringement of any third party’s rights.

15. Termination

You may terminate your account at any time via account settings.

We may suspend or terminate your account if:

  • You materially breach these Terms.
  • We are required to do so by law or by a competent authority.
  • Your account is dormant for an extended period (we will email you first).
  • Your subscription remains unpaid after a reasonable grace period.

On termination, we will retain or delete your data in accordance with the retention schedule in our Privacy Policy.

16. Privacy

Your use of Budget Hub is also governed by our Privacy Policy, which explains how we collect, use, store, and share your personal information in compliance with POPIA. By accepting these Terms you confirm that you have read and accept the Privacy Policy.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You agree that any dispute arising from these Terms or your use of the service will be resolved in the courts of the Western Cape Division, unless otherwise required by the Consumer Protection Act.

Before approaching a court, both parties agree to attempt to resolve the dispute in good faith for at least 30 days.

18. Changes to these Terms

When we make material changes to these Terms we will bump the version number at the top, email you, and ask you to re-accept the updated Terms the next time you log in. Minor clarifications may be made without re-acceptance.

19. Severability and waiver

If any provision of these Terms is found to be invalid or unenforceable, the rest of the Terms remain in effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
